ERISA – Taft-Hartley Funds
KHPP ERISA Practice Group provides expert legal counsel regarding the Employee Retirement Income Security Act of 1974 (ERISA) and related areas of interest to our current Taft-Hartley Fund clients in the construction, transportation and service industries. The Firm’s collection services meet a primary need of our Taft-Hartley Fund clients by ensuring that delinquent fund contributions are appropriately recovered on behalf of our clients. This practice includes the institution of claims on behalf of our clients under various theories, including alter ego liability, successor liability, piercing the corporate veil, and withdrawal liability. In addition, we work closely with the Funds staff and Trustees on a daily basis with respect to ERISA, IRS and PBGC issues involving:
- Proper delegation of fiduciary responsibilities
- Appointment, monitoring and removal of Trustees
- Appointment of professional advisors

- Developing investment policies and monitoring of Funds assets
